A notice may be submitted by a person or entity that believes that an element of FootDraft infringes their rights. A notice may come in particular from a player, agent or player representative, football club, league, federation, competition organizer, trademark owner, copyright owner, database owner or producer, law firm or other representative of an authorized entity. If the notice is submitted by a representative, the representative should indicate whom they represent and on what basis they act.
The notice should be sent to [email protected]. The email subject should preferably be “FootDraft - infringement notice” or “FootDraft - IP notice”. The notice should be as specific as possible and include information allowing the issue to be identified.
The notice should include the name of the reporting person or entity, contact details, information whether the reporting person acts on their own behalf or as a representative, identification of the represented entity, description of the rights concerned, identification of the specific FootDraft element, explanation of the objection, a link, screenshot, in-game location description or other information helping to find the indicated element, the requested resolution and a statement that the information in the notice is true to the best knowledge of the reporting person.
The notice should not contain unnecessary personal data. Do not send passwords, login details, payment data or documents containing sensitive data unless absolutely necessary to handle the notice. If the notice concerns a user account, provide only the information necessary to identify the matter.
After receiving a notice, the Operator may confirm receipt, request additional information, analyze the indicated game element, temporarily hide it, change it, remove it or refuse action if the notice is unfounded, incomplete, imprecise or does not concern the reporting party's rights. The Operator may take temporary action before completing the full analysis if it considers this reasonable for legal, technical, security or reputational reasons.
Changing, hiding or removing a FootDraft element after receiving a notice does not mean that the Operator admits that any infringement occurred. Such action may be taken to limit a dispute, reduce risk, protect the game, protect users or maintain good relations with rights-holders. The Operator may take an amicable action without deciding whether the notice was legally justified.
The Operator will try to review notices within a reasonable time. The response time may depend on the completeness of the notice, complexity of the matter, number of notices, availability of the Operator, need for additional information and risk connected with the indicated element. Incomplete, general notices or notices not identifying a specific game element may require clarification and therefore take longer to handle.
The Operator may refuse action if a notice is clearly unfounded, malicious, spammy, mass-submitted, imprecise or abuses the procedure. The Operator may not respond to messages that do not contain a specific notice, are spam, contain threats without a factual issue description, attempt to obtain data fraudulently, do not allow identification of the game element or do not concern FootDraft.
If a report concerns an error in game data, such as an incorrect name, nationality, season, position, team abbreviation or rating, it may be sent to [email protected]. Such a report should indicate what element is incorrect, where the error appears, what correction is proposed and optionally a source confirming the correct information. Ratings, statistics and chemistry values are part of FootDraft's original system and may differ from real, official or other-game evaluations.
If a report concerns a user account, nickname, ranking, user behavior or other community element, it should indicate the nickname, description of the issue, date or approximate time of the event and a screenshot or other evidence where available. The Operator may remove or change a nickname, hide a ranking entry, block an account or take other actions in accordance with the Terms.
Personal data provided in a notice will be processed to handle the notice, contact the reporting person, document the matter, protect the Operator's rights, defend against claims and prevent abuse. Detailed rules for personal data processing are described in the FootDraft Privacy Policy.
This Procedure supplements the FootDraft Terms of Service, Privacy Policy, Cookies and Local Storage Policy and IP Disclaimer / No Official Affiliation. For notices concerning personal data, the Privacy Policy also applies. For violations of game rules, the Terms also apply.
The Operator may update this Procedure, especially if the way FootDraft works changes, the scope of data or identifiers used in the game changes, new features appear, new legal risks appear, laws change or the notice rules need clarification. This Procedure applies to the free beta version of FootDraft. Before introducing advertising, payments, premium features, additional analytics, marketing communications or material changes to the game identifiers or notice process, this document should be updated.
